Vor dem Verfassungsgericht fand eine Anhörung im Fall von Alfredo Cospito und Anna Beniamino wegen des Vorwurfs des politischen Massakers (Art. 285 des Strafgesetzbuches) im Rahmen des Scripta-Manent-Prozesses statt.
Es sei darauf hingewiesen, dass das derzeitige Cirielli-Gesetz (Jahr 2005, Regierung Berlusconi) verhindert, dass mildernde Umstände im Falle eines Rückfalls die erschwerenden Umstände ausgleichen können. Im Fall von Alfredo Cospito hätte dies eine lebenslange Freiheitsstrafe bedeutet, obwohl die ihm und Anna vorgeworfene Tat keine Opfer gefordert hat.
Das Gericht erklärte diese Regelung daher für verfassungswidrig. In der
Pressemitteilung des Palastes geht hervor, dass das Gericht generell Zweifel an der Verfassungsmäßigkeit all jener Fälle geäußert hat, in denen die festgesetzte Strafe nur lebenslange Haft ist.
Der anarchistische Gefangene Alfredo Cospito befindet sich seit fast sechs Monaten im Hungerstreik, um sich gegen die lebenslange Freiheitsstrafe von 41 bis zu wehren. Ein Kampf, für den sein Genosse sein Leben riskiert hat und bei dem er offenbar irreversible neurologische Schäden erlitten hat. Alfredos Widerstand war nicht nur für ihn selbst, sondern für alle, insbesondere in Solidarität mit anarchistischen, kommunistischen und revolutionären Gefangenen. Diese Entscheidung wird sich nicht nur auf das Schicksal unseres Genossen auswirken, sondern ist auch ein, wenn auch begrenzter, Schlag gegen die Institution der lebenslangen Haft in Italien.
Dieser politische Sieg war das Ergebnis des Widerstands von Alfredo und der Solidaritätsbewegung, sowohl in Italien als auch auf internationaler Ebene. Viele Organisationen, Revolutionäre, Anarchisten, Kommunisten, Solidaritätskomitees und fortschrittliche Menschen haben sich an Solidaritätsaktionen beteiligt. In vielen verschiedenen Ländern verbreiteten die Menschen die Stimme von Alfredo und forderten die Abschaffung des 41-bis Isolationsregimes. Denn Isolation ist eine Folter. Es ist eine Politik des Imperialismus, um die Revolutionäre anzugreifen, um sie zur Kapitulation zu zwingen. Deshalb ist dieser Kampf von Alfredo nicht nur ein Kampf für ihn, sondern für alle Menschen, die gegen Imperialismus, Faschismus und Ungleichheit kämpfen. Anarchist prisoner Alfredo Cospito has been on hunger strike for almost six months precisely against 41 bis and hostile life imprisonment. A struggle for which his comrade risked his life and during which he appears to have suffered irreversible neurological damage. Alfredo’s resistance was not just for himself, but for everyone, particularly in solidarity with anarchist, communist and revolutionary prisoners. This decision will have consequences not only for the fate of our comrade, but is a blow, however limited, to the institution of life imprisonment in Italy.
This political victory was a result of resistance of Alfredo and for solidarity movement, inside Italy and also internationaly. Many organisations, revolutionaries, anarchists, communists, solidarity committees, progressive people join make solidarity actions. In many different countries people spread the voice of Alfredo and demand abolish of 41-bis isolation regime. Because isolation is a torture. Is a policy of imperialism to attack to the revolutionaries, to make them to surrender. That’s why this struggle of Alfredo is a struggle not only for him, but also for all the people who fight against imperialism, fascism and unequality. Is a struggle for all those who resist for freedom and justice.
