Der Paragraph 129 des Strafgesetzbuches (StGB) hat eine 200-jährige Geschichte. In dieser änderte sich der Name, der Inhalt blieb immer derselbe: Wer sich gegen die aktuelle Staatsführung richtet, wird dafür bestraft. Unter dem Namen § 129 mit seinen Anhängsel a und b, ist er die aktuellste Form in der Geschichte staatlicher Gesinnungsverfolgung in Deutschland.

Seine Wurzeln reichen bis in das Jahr 1822, wo er als „Staatsschutzgesetz“ gegen die bürgerliche Revolution in Deutschland fungierte. Später wurde er gegen Demokrat:innen und Sozialist:innen angewandt, die Öffentlichkeit für die Pariser Kommune im Jahre 1871 schaffen wollten. Im Nazideutschland zwischen 1933-1945 wurden Regimekritiker:innen, Oppositionelle und Widerständige auch nach diesem Paragraphen angeklagt. 1951 im Zuge der sogenannten „Entnazifizierung“ und einer Überprüfung des StGB behielt die alte BRD (in welcher 80% der Richter auch als Richter im NS-Regime arbeiteten) den Paragraphen, mit der demagogischen Begründung, zu verhindern, dass „Nazis erneut erstarken“. Mitte der 70er Jahren, während einer Hochzeit militanter antiimperialistischer Kämpfe in der BRD, wurde der § 129 mit den Zusatz a erweitert, welcher einen diffusen Begriff des „Terrorismus“ mitbrachte. Im Jahre 2002 folgte dann die nächste und vorerst letzte Erweiterung um den Zusatz b (Terroristische Vereinigung im Ausland).

Die Erweiterungen machten eine neue Stufe der Repression möglich, bspw. wurde „Propaganda“ in den Straftatbestand inkludiert, das heißt u. a., dass keine illegale Aktivität vorliegen muss, um unter dem Vorwurf (Vorwand) des Terrorismus verfolgt zu werden. Diese Paragraphen deren Anwendung in der BRD nur auf Anweisung des Bundesjustizministeriums und Außenministeriums möglich sind bringen ebenfalls Sonderregelungen mit sich, welche die Grundrechte der Beschuldigten beschneiden. Die §§ 129ff. sind ein Angriff auf Rechte und Freiheiten sowie auf das Widerstandsrecht. Somit ist es nichts weiter als legales Unrecht!

Heute wie damals sehen sich viele linke Aktivist:innen und Revolutionär:innen in Deutschland mit der Verfolgung durch die §§ 129, 129a und b konfrontiert. Vor allem Sozialist:innen aus der Türkei und Kurdistan werden zur Zielscheibe dieser Angriffe unter dem § 129b. Drei von ihnen sind Özgül Emre, İhsan Cibelik und Serkan Küpeli. Sie wurden im Mai 2022 festgenommen und sind seitdem in deutschen Gefängnissen eingesperrt.

Anlässlich dessen haben wir, als Antifaschist:innen und Antiimperialist:innen, ein Bündnis gegründet. Wir werden eine Einheit gegen die Staatsrepressionen und Kriminalisierung von antagonistischen Kräften sein. Wir werden nicht zulassen, dass uns unsere demokratischen Rechte weggenommen werden. Wir wissen genau, wenn wir uns heute nicht gegen die Willkür der §§ 129 einsetzen und uns nicht organisieren, dann werden wir die Nächsten sein.

Im Rahmen der Kampagne „Weg mit dem Paragraphen 129“ werden wir für alle antifaschistischen und linken Gefangenen in Deutschland, die mit dem Paragraphen 129, 129a oder 129b verurteilt werden, kämpfen. Unser Zwischenziel ist es, dass der Prozess von Özgül, İhsan und Serkan auf freiem Fuß fortgesetzt wird.

Mit einem Langen Marsch wollen wir über den Paragraphen informieren (seine Historie sowie seine Anwendung anhand aktueller Beispiele), mit euch ins Gespräch kommen, Öffentlichkeit schaffen und Solidarität mit den Betroffen organisieren.

Der Marsch beginnt Ende Januar 2023 in Berlin und wird in mehreren Städten halt machen. Call: Long March under the slogan „Away with the paragraph 129!“.

The Paragraph 129 of the Criminal Code (StGB) of Germany has a 200-year history. Throughout the time, the name changed, but the content always remained the same: Whoever opposes the status quo, is punished for it. Under the name § 129 with its appendages a and b, it is the most recent form in the history of state persecution of freedom of speech in Germany.

Its roots go back to 1822, when it functioned as a „state protection law“ against the bourgeois revolution in Germany. It was later applied against democrats and socialists who wanted to create publicity for the Paris Commune in 1871. In Nazi Germany between 1933-1945, critics of the regime, oppositionists and resisters were also charged under this paragraph. In 1951, in the course of the so-called „denazification“ and a review of the StGB, the old Federal Republic of Germany (FRG), where 80% of judges also worked as judges in the Nazi regime, retained the paragraph with the demagogical justification of „preventing Nazis from gaining strength again“. In the mid-1970s, during the heydays of militant anti-imperialist struggles in the FRG, the § 129 was expanded with the addition of section a, which brought with it a diffuse notion of „terrorism“. In 2002, the next and for the time being last extension followed, with the addition of section b (foreign terrorist organization).

The extensions made a new level of repression possible. For example, „propaganda“ was included in the criminal offense, which means, among other things, that no illegal activity must be present in order to be prosecuted under the accusation of terrorism. These paragraphs, which in the FRG can only be applied under the instructions of the Federal Ministry of Justice and the Ministry of Foreign Affairs, also contain special provisions that restrict the fundamental rights of the defendant. The §§ 129ff. are an attack on the rights and the liberties of people, as well as on the right to resist. Thus it is nothing more than legal injustice!

Today, as then, many left-wing activists and revolutionaries in Germany are confronted with persecution under §§ 129, 129a and b. Especially socialists from Turkey and Kurdistan are the target of these attacks under § 129b. Three of them are Özgül Emre, İhsan Cibelik and Serkan Küpeli. They were arrested in May 2022 and have been locked up in German prisons since then.

On the occasion of this, we, as anti-fascists and anti-imperialists, have formed an alliance. We will be a unity against the state repression and criminalization of antagonistic forces. We will not allow our democratic rights to be taken away from us. We know very well that if we do not stand up today against the arbitrariness of §§ 129 and do not organize, we will be the next.

Within the campaign „Away with the paragraph 129“ we will fight for all antifascist and left prisoners in Germany who are sentenced under the paragraphs 129, 129a or 129b. Our intermediate goal is that the process of Özgül, İhsan and Serkan continues without pre-trial detention and they are set free.

With a Long March, we want to inform about the paragraph (its history, as well as its application, based on current examples), get into conversation with you, create publicity and organize solidarity with those affected.

„129 Yasaları Kaldırılsın!“ Sloganıyla Uzun Yürüyüş’e Başlıyoruz.

Almanya Ceza Kanunu’nun (StGB) 129. Paragrafı 200 yıllık bir geçmişe sahip. Zaman içinde adı değişse de içeriği hep aynı kaldı: Devlete ve düzene karşı çıkan herkes cezalandırılmalıdır. Madde 129 adı altında a ve b ekleriyle birlikte, Almanya’da ifade özgürlüğüne yönelik devlet baskısının en yeni formudur.

Kökleri, Almanya’daki burjuva devrimine karşı bir „devlet koruma yasası“ olarak işlev gördüğü 1822 yılına kadar uzanmaktadır. Daha sonra 1871’de Paris Komünü için kamuoyu yaratmak isteyen demokrat ve sosyalistlere karşı uygulanmıştır. Nazi Almanya’sında 1933-1945 yılları arasında rejimi eleştirenler, muhalifler ve direnişçiler de bu fıkra kapsamında suçlanmıştır. 1951 yılında, „denazifikasyon“ olarak adlandırılan ve StGB’nin gözden geçirilmesi sırasında, yargıçların %80’inin Nazi rejiminde de yargıç olarak çalıştığı eski Federal Almanya Cumhuriyeti (BRD), „Nazilerin yeniden güç kazanmasını önlemek“ gibi demagojik bir gerekçeyle bu yasayı korudu. 1970’lerin ortalarında, BRD’deki militan anti-emperyalist mücadelelerin en ileri günlerinde, 129. madde, beraberinde dağınık bir „terörizm“ kavramı getiren a bölümünün eklenmesiyle genişletildi. O gün olduğu gibi bugün de Almanya’da birçok sol aktivist ve devrimci 129, 129a ve b kapsamında zulümle karşı karşıyadır. Özellikle Türkiyeli ve Kürdistanlı sosyalistler § 129b kapsamında bu saldırıların hedefindedir. Bunun en yakın örneği Özgül Emre, İhsan Cibelik ve Serkan Küpeli’nin 2022 Mayısında tutuklanmasıdır. Üçü de hala cezaevinde tutuluyorlar.

Bunun vesilesiyle biz anti-faşistler ve anti-emperyalistler olarak bir ittifak oluşturduk. Devlet baskısına ve muhalif güçlerin kriminalize edilmesine karşı bir birlik olacağız. Demokratik haklarımızın elimizden alınmasına izin vermeyeceğiz. Çok iyi biliyoruz ki, 129. maddenin keyfiliğine karşı bugün ayağa kalkmaz ve örgütlenmezsek, sıradaki biz olacağız.

„129. paragraf kaldırılsın“ kampanyası kapsamında Almanya’da 129, 129a veya 129b paragraflarından ceza alan tüm antifaşist ve sol tutsaklar için mücadele edeceğiz. Ara hedefimiz Özgül, İhsan ve Serkan’ın tutuksuz yargılanma süreçlerinin devam etmesi ve serbest bırakılmalarıdır.

Uzun Yürüyüş ile bu fıkra hakkında bilgi vermek (tarihçesi ve güncel örnekler üzerinden uygulaması), sizlerle sohbet etmek, kamuoyu yaratmak ve mağdurlarla dayanışmayı örgütlemek istiyoruz.
